These Terms and Conditions govern access to and use of the website www.ticosusa.com (hereinafter, the “Site”), operated by TicosUSA (hereinafter, the “Company,” “we,” or “our”).
By accessing, browsing, or using the Site, the user (hereinafter, the “User”) expressly and fully accepts these Terms and Conditions. If you do not agree with any of the provisions described here, you must refrain from using the Site.
1. Purpose of the Website
TicosUSA is a platform that enables users to purchase Costa Rican products from the United States, American products from Costa Rica, and contract logistics, shipping, customs, and delivery services between both countries. The Company reserves the right to modify, expand, or remove products and services without prior notice.
2. User Eligibility
The User declares to be of legal age and have the legal capacity to contract under the applicable law of their country of residence. If acting on behalf of a company or entity, the User represents having the necessary authority to bind that organization.
3. Account Registration
To access certain services, the User may be required to register and create an account. The User is responsible for maintaining the confidentiality of their password and for all activity under their account. The Company is not liable for any loss or damage resulting from unauthorized use.
4. Purchases and Payments
All products and services offered are subject to availability. Prices may change without notice. Payments must be made in the currencies and methods authorized at the time of checkout.
TicosUSA reserves the right to cancel orders due to stock errors, incorrect pricing, or suspected fraud, with appropriate notice to the User.
5. Shipping and Logistics
Delivery times and shipping conditions will be specified per case, depending on the destination, product type, and service. The Company is not responsible for delays caused by customs, external carriers, or force majeure.
6. Returns and Refunds
Requests for returns or refunds must be made within the time period stated in the returns policy published on the Site. Certain products are not eligible for return due to hygiene, customization, or perishable nature.
7. User Responsibilities
The User agrees to use the Site and its services in accordance with the law, public order, and these Terms and Conditions. The Site must not be used for illegal or fraudulent purposes or in ways that may harm third parties or the Company.
8. Intellectual Property
Unless otherwise indicated, all content on the Site (text, images, design, logos, etc.) is the property of TicosUSA or used under license from third parties. Reproduction or use of any content without written authorization is prohibited.
In the case of third-party products, the respective brand and image rights belong to their owners.
9. Modifications
TicosUSA may amend these Terms and Conditions at any time. Changes will take effect upon being published on the Site. Continued use implies acceptance of such modifications.
10. Third-Party Links
The Site may contain links to third-party websites not operated by the Company. TicosUSA is not responsible for the content, policies, or practices of such sites.
11. Limitation of Liability
The Company does not guarantee uninterrupted availability of the Site or absence of errors. It is not liable for direct or indirect damages resulting from Site use or third-party content errors.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Costa Rica and, where applicable, the laws of the United States of America. Any dispute will be submitted to the competent courts at the Company’s legal address, unless otherwise legally required.
